The Race For Gun Control In America

Just last Thursday, the Vice President of the United States met with a delegation from the NRA, other gun organizations, and large retailers of guns in America. The meeting was billed as a conversation to enact meaningful ways to curb gun violence in America. Apparently, this “conversation” was completely one-sided.

Apparently, Mr. Biden was completely unwilling to listen to any of the points the NRA and other gun organizations put forward. The meeting obviously was just for show and according to NRA President David Keene, “Biden was just checking a box”. The NRA went so far as to say that this administration has an “agenda to attack the Second Amendment”.  In affirmation of Mr. Keene’s point, the Vice President held a press conference in which he said:  “There are executive orders…executive action can be taken.” To me, this means that the current administration is willing, once again, to bypass Congress and to ignore the Constitution in order to dictate to the American people what they can and can’t do.  The administration also is distorting actual facts about violent crime in America. 

The current administration’s position is “facts be damned”, thereby misleading the American people about actual facts and statistics dealing with violent crime in America.  Facts are something that most Liberals really hate. Facts tend to get in the way of the well-orchestrated sound bites that liberal politicians put out to the media which is, nine times out of ten, too busy to check those facts.  These non-factual sound bites are shouted from the rooftops and repeated over and over again until the unaware voter takes them as holy words.

On the other hand, as a business person, I like facts. I wouldn’t make a move in business without some hard facts.  Let’s take a look at these pesky facts.  We keep hearing that America is an extremely violent country…much more violent than our civilized European cousins who have enacted “sensible” gun controls -- countries like Great Britain for instance. Really?  I don’t think so.  The facts are, according to the FBI website, that there were 386.3 violent crimes in America for every 100,000 people in 2011. According to the Home Office website (GB’s equivalent to the FBI), there were 1361 violent crimes per 100,000 people in 2011. Here’s another fact: while not all of those violent crimes included guns, there still were 3½ times as many violent crimes in Great Britain, a free country that has stringent gun control, as there were in America.  I also can safely say that the victims of those crimes could not have cared less what implement the criminal used to carry out the crime. Could it be that rapists’, murderers, and robbers think twice when they know their victim might be carrying a gun?  Of course it can!

I know there are many more issues I could be addressing here, including mental health and society as a whole and I will be addressing those issues at a later date. But for now, we must join together as Americans and fight the takeover and dismantling of our constitutional rights by a dictatorial administration.

I will be introducing a bill in the upcoming Legislative session based on a bill that currently is working its way through the Wyoming Legislature (HB0104) to ensure our Second Amendment rights in Nevada. I hope you will join with me in support of our constitutional rights.

Thank you so much Mr Wheeler. I'm a Reno resident and I am extremely happy that you're making this initiative. I support our state's right to protect it's citizen's natural rights... those same God-given rights that are enumerated, but not granted, by the amendments.

Do it! I am fed up with hearing about how guns are the root of all evil. WHEN are people going to stop equating owning a gun to the sick, twisted people who are the REAL problem?!

Mr Wheeler it was an absolute pleasure reading your proposal. Truth be told I was hoping someone in our legislature was willing to follow Wyoming's lead on this and I was more than pleased upon reading what you have planned. This is not California and the citizens here in Nevada enjoy our 2nd amendment rights and look to constantly re-elect those who share the same. Thank you again for the time and effort it will take to get this passed as well as keeping the citizens of Nevada safer than all those other dangerous metropolitan cities with strict gun laws and rampant crime. My hat is off to you sir.

Mr Wheeler, I have family that resides in the State of Colorado. I believe that the only reason Colorado does not recognize Nevada Concealed Weapons licenses is because Nevada fails to recognize Colorado's. Hence, we're in a catch-22 scenario. Do you think you can help correct such a conundrum this next session?

Ben, I believe Assemblywoman Fiore is re-introducing a bill request that would allow 50 state carry. If so, I will be proud to cosponsor it. She also is one of our strongest advocates of 2nd amendment rights in the Assembly.

Mr. Wheeler,

I am what I consider a reasonable, left-leaning centrist, though you'd probably call me a liberal. While I don't own guns, I've used guns plenty, and I thoroughly understand the reasons for the Second Amendment. There are valid arguments to be made for gun ownership. But there are also valid arguments against certain types of gun ownership. Any reasonable representative would recognize this.

I, too, like facts, and not enough people pay attention to them. So I read with amazement the story in the RGJ yesterday where you state:

“What my bill says is if the president does an executive order on gun control, the state of Nevada will not recognize that law and will direct the attorney general to defend anyone arrested under that law.”

Let me point out a simple, completely unseen fact in all this "executive order" hysteria:

THE PRESIDENT CANNOT ENACT LAWS THROUGH EXECUTIVE ORDER. Additionally, Obama's 23 executive actions do not make any attempt to create law through executive privilege.

Have you read the list? Launch a safe and responsible gun ownership campaign? Review gun safety standards? Improve information sharing in the background check system? Provide law enforcement and first responders with training for situations like Sandy Hook?

Oh yes, and provide incentives for schools to hire SROs (school resource officers, who almost always carry guns)!

How dare he, the tyrant!

Obama has issued a total of 143 executive orders to date. That's right in line with G.W. Bush (145 per four-year term), Clinton (181 per four-year term), George HW Bush (165), and Reagan (190). (source: http://www.archives.gov/federal-register/executive-orders/disposition.html)

Your bill addresses a nonexistent problem. Please stop wasting taxpayer dollars on straw-man arguments, and moreover, stop feeding into ridiculous hysteria that does nothing to further SANE AND PRODUCTIVE NATIONAL DISCOURSE.

It's unbecoming of an elected official, and I expect elected officials to know better, and I expect them to know how our government works.

It is true there is a lot of hysteria about Executive Orders. The perception is they have the weight of law. Because our federal elected officials have not stopped the lawlessness of Obama & his toadies most American's believe what he is doing is lawful; so they will obey his unlawful laws, i.e. the mandate against drilling in the Gulf of Mexico. A Louisiana judge declared the moratorium must be lifted, his ruling was ignored & no one challenged Obama. His Attorney General, Eric Holder, declared he will no longer enforce DOMA (Defense of Marriage Act) & behold, that is not challenged, either. The Senate has refused to pass a budget for over 3 years; they are breaking the law. I could mention other instances but you get the picture. Until our spineless federal elected officials force the Obama Administration to obey the US Consitution bless Assemblyman Jim Wheeler & others in our State House who are working to protect WE THE PEOPLE from the elite American outlaws.

Dear Shane:

While I try to answer every email and letter I get personally, the overwhelming response I have received in support of our 2nd amendment rights has somewhat precluded that option in all but a few cases. However, I felt your well thought out and well written email certainly deserved a personal response. The great thing about this Country is the fact that we can have open discussion and oppose each other’s views without rancor.

You say in your email that you “read with amazement” the story in which I explain about the part of my bill that would preclude the state of Nevada adhering to any Executive Order written by the President concerning the diminishment of our 2nd amendment rights. You correctly point out that “THE PRESIDENT CANNOT ENACT LAW THROUGH EXECUTIVE ORDER”. On this point, I wholeheartedly agree. He cannot. You go on to say that Obama’s 23 executive actions do not make any attempt to create law. And again, though to a smaller extent, I somewhat agree. However, in my opinion some of those E.O.’s (and yes Mr. Iseminger, I have read them.) will diminish the 4th amendment rights guaranteed by our Constitution. However, while definitely a problem that needs to be addressed, this is not the main problem.

The problem is the fact that the Vice President, after a meeting with national gun organizations and major retailers, was asked by the press what the Administration was going to do about gun control given the fact that the Congress would most likely be unable to pass any laws on the subject. His response, and I quote, was “There are Executive Orders. There are Executive actions we can take and this President is willing to take them”. That sir, scares the heck out of me and should scare you too. My bill precludes this from happening in Nevada and reminds the President that, as you say, he cannot write law through Executive Order. Only the Congress of the United States can do that at the federal level.

You go on to say that my bill addresses a nonexistent problem. I certainly hope so. But given the above statements put forth by the Vice President, I don’t think Nevada Citizens can take that chance.

I have had many Legislators ask about the bill. Even some Democrats that believe in our 2nd amendment rights as well. We'll have to see how many sign on when the draft becomes a bill in Feb.

Mr Wheeler, I noticed that SJR3 was filing recently. I understand that SJR3 is similar in asserting that the state has its own rights, but this SJR3 does not make it explicitly clear that it be a felony for federal officials to enforce laws in violation of that granted by the states. It does not direct the State Attorney General to defend citizens of the state from federal agents who exceed the rights granted to them by the States.

Please tell me that more than a joint resolution is coming down the pipeline... this is not enough.

SJR3 is a resolution that reaffirms all states rights and demands that the federal government stop holding back funds from programs (such as educational programs) unless the state cow-tows to their demands as far as how the monies are spent.
BDR-945 is the second amendment rights bill for Nevada that directs the Attorney General to defend citizens who are arrested under laws against the 2nd amendment issued by Executive Order. It has not been assigned a bill number yet.
I will let you all know when we have a bill number and when it will be going to a committee for a hearing.

Owning a gun is quite a normal thing. There are several reasons why people have hand guns or rifles in their homes. Some people have them because they use them for hunting.
